Maryland Marital Separation Agreement
This Maryland Marital Separation Agreement (hereinafter referred to as "Agreement") is entered into on this ___ day of ______, 20__, by and between ____________________ (hereinafter referred to as "Spouse 1") and ____________________ (hereinafter referred to as "Spouse 2"), both of whom agree to be bound by the conditions set forth herein conforming to the laws of the State of Maryland, specifically referencing the Family Law Article of the Annotated Code of Maryland.
WHEREAS, the parties were lawfully married on the ___ day of ____________, 20__, in _______________, Maryland, and now desire to live separate and apart from each other, yet have agreed to the following terms concerning their separation and the resolution of issues arising from their marriage.
WHEREAS, both parties wish to define their rights and responsibilities towards each other and towards their children, if any, regarding custody, visitation, child support, spousal support, division of property, and debt, and have endeavored to resolve these matters amicably.
NOW, THEREFORE, in consideration of the mutual promises contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:
- Children: The parties do / do not have minor children. If there are minor children born or adopted during the marriage, the following are agreed upon:
- Custody arrangements
- Visitation schedules
- Child support details
- Spousal Support: Both parties agree that spousal support shall be provided as follows:
- Duration and amount of support
- Conditions for modification or termination of support
- Division of Property: The parties agree to the division of both marital property and debts as outlined below:
- Real estate and property distribution
- Division of personal property, such as vehicles, furniture, etc.
- Assignment of debts and obligations
- Separate Property: Each party confirms that property listed as separate (acquired before the marriage or by inheritance/gift) shall remain so, and the division of marital property does not apply to such separate property.
- Legal and Physical Separation: The parties hereby acknowledge their intent to live separately, abiding by the terms set forth in this Agreement. Each agrees to reside at separate addresses and refrain from disturbing the peace of the other. The legal status of their separation is recognized according to the laws of the State of Maryland.
- Additional Terms: Any additional agreements, including but not limited to tax filing and insurance benefits, are included in this section.
- Modification of Agreement: Any modifications to this Agreement must be made in writing and signed by both parties. Verbal agreements shall not be considered valid modifications.
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland.
